Digital Video Game Products Terms and Conditions—United States
These Digital Video Game Products Terms and Conditions (“Digital Game Terms”) apply to the purchase, receipt, redemption, and usage of digital video games, full game downloads, in-game currency, and subscription memberships (“Digital Game Products”) available on the DoorDash platform for users in the United States and are between you, the purchaser or recipient; DoorDash Giftcards LLC, a Virginia limited liability company (“DDGC”); and DoorDash, Inc., a Delaware corporation (“DoorDash” and, collectively with DDGC, “we,” “us,” or “Company”). By purchasing, accepting, redeeming, or using a Digital Game Product, you agree to both these Digital Game Terms and also the DoorDash Consumer Terms and Conditions and the DoorDash Gift Card Terms and Conditions, including the arbitration and class waiver provision therein (collectively, the “Terms and Conditions”). If you do not agree with the Terms and Conditions, do not purchase, accept, redeem, or use a Digital Game Product.
The Digital Game Products consist of digital redemption codes or PINs issued in partnership with InComm Digital Solutions, LLC, a Delaware limited liability company (“InComm”), representing digital games from third-party providers (including but not limited to Nintendo, Microsoft, Electronic Arts, and Blizzard). DDGC is the sole legal obligor to the purchaser for the transaction; provided, however, that the game codes, software, services, and digital content themselves are provided by external game publishers. DoorDash and its subsidiaries and affiliates other than DDGC bear no responsibility or liability for any Digital Game Products, and you hereby knowingly release DoorDash and its subsidiaries and affiliates other than DDGC from any and all liability or claims of any nature whatsoever arising in connection with the Digital Game Products.
Digital Game Products are delivered exclusively electronically via email to the recipient email address provided at the time of purchase. Digital Game Products are currently available only through the DoorDash mobile application to users in the United States. You must have a valid DoorDash account to purchase a Digital Game Product. Redemption codes do not expire unless otherwise explicitly stated by the underlying publisher. Once a Digital Game Product code is delivered via email, it must be redeemed directly on the respective third-party gaming platform (such as microsoft.com, Nintendo eShop, or other publisher networks) in accordance with that platform's specific hardware, software, account, and system requirements. We further reserve the right to deactivate, cancel, or suspend orders or codes when we suspect fraud, unlawful activity, or any violation of the Terms and Conditions.
All digital video game sales are final. Once a digital game, game currency, subscription, code, or other digital content has been delivered via email, purchases are strictly non-refundable, non-exchangeable, and non-cancelable. Digital Game Products may not be resold. If applicable, DoorDash Credits and DoorDash Gift Cards may be used to purchase Digital Game Products. Applicable state and local taxes may be charged where required by law and will be calculated and displayed during checkout before your purchase is completed.
A Digital Game Product code is valid only if obtained directly through the authorized DoorDash app. Neither DDGC nor DoorDash shall be liable for codes that are undelivered or missing due to user transmission errors, including but not limited to the entry of an incorrect recipient email address, or external technical filters such as email spam or junk mail folders , school or corporate firewalls, or accidental email deletions.
Lost, damaged, or stolen digital codes or redemption emails will not be replaced or replenished once successfully dispatched. Neither DDGC nor DoorDash is responsible for unauthorized use or redemption of a code after delivery to the provided email address.
We reserve the right to enforce transaction limits on the purchase of Digital Game Products. You may not purchase or obtain more than the maximum daily or single-transaction limits established within the DoorDash application or as required by our backend distribution agreements.
TO THE FULLEST EXTENT OF LAW, COMPANY SHALL NOT BE LIABLE TO ANYONE FOR ANY INDIRECT, PUNITIVE, SPECIAL, EXEMPLARY, INCIDENTAL, CONSEQUENTIAL, OR OTHER DAMAGES OF ANY TYPE OR KIND IN ANY WAY CONNECTED WITH DIGITAL GAME PRODUCTS. COMPANY SHALL NOT BE LIABLE FOR ANY LOSS, DAMAGE, OR INJURY WHICH MAY BE INCURRED BY YOU, INCLUDING BUT NOT LIMITED TO LOSS, DAMAGE, OR INJURY ARISING FROM THIRD-PARTY GAMING PLATFORM DOWNTIME , API INTEGRATION INTERRUPTIONS, OR PUBLISHER CODE ERRORS. TO THE FULLEST EXTENT PERMISSIBLE BY LAW, IN THE EVENT A DIGITAL REDEMPTION CODE IS COMPLETELY NON-FUNCTIONAL DUE TO A SYSTEM TRANSACTING ERROR PRIOR TO REDEMPTION, YOUR SOLE REMEDY, AND OUR SOLE LIABILITY, WILL BE THE REPLACEMENT OF THAT CODE.
You agree that any dispute or claim relating in any way to Digital Game Products will be resolved by binding arbitration rather than in court in accordance with the DoorDash Consumer Terms and Conditions. Please review the DoorDash Consumer Terms and Conditions carefully to understand how disputes will be resolved and your right to opt out.
DDGC reserves the right to change these Digital Game Terms from time to time in its discretion without special notice to you. Notice of changes will be by reasonable means, which may be by the posting of the revised version of these Digital Game Terms online (“Updated Terms”). Your purchase or use of a Digital Game Product after DDGC has posted the Updated Terms constitutes your agreement to the Updated Terms. The Updated Terms will be effective as of the time of posting or such later date as may be specified in the Updated Terms.
