DashPass Gift Membership Terms and Conditions - United States

The following DashPass Gift Membership Terms and Conditions describe the terms and conditions that apply to the purchase and/or use of DashPass gift memberships or subscriptions (the “DashPass Gift Memberships”). These DashPass Gift Membership Terms and Conditions are between you, the purchaser and/or holder of the DashPass Gift Membership (“You”), and DoorDash Giftcards LLC (“DDGC”), a Virginia limited liability company. By purchasing, accepting, or using a DashPass Gift Membership, You agree to both these DashPass Gift Membership Terms and Conditions and also the DoorDash Consumer Terms and Conditions, including the arbitration and class waiver provision therein (collectively with the DashPass Gift Membership Terms and Conditions, the “Terms and Conditions”). If You do not agree with the Terms and Conditions, do not purchase, use, or accept the DashPass Gift Membership.

DashPass Gift Memberships are issued by DDGC, and DDGC is the sole legal obligor to You; provided, however, that DDGC may assign its obligations with respect to the DashPass Gift Membership at any time, in which case such assignee shall become the issuer and sole legal obligor to You. DoorDash, Inc. and its subsidiaries and affiliates other than DDGC (collectively, “DoorDash”) bear no responsibility or liability for any DashPass Gift Memberships, and you hereby knowingly release DoorDash from any and all liability or claims of any nature whatsoever arising in connection with the DashPass Gift Membership.

You must have or create a valid DoorDash account with a valid form of accepted payment on file and accept the DoorDash Consumer Terms & Conditions to purchase and/or redeem a DashPass Gift Membership. DashPass Gift Memberships cannot be redeemed by DashPass members currently enrolled in any free, paid, or discounted partnership membership plan including, but not limited to, a Chase or Mastercard plan (“Excluded Membership Plan”). In the event that a recipient of a DashPass Gift Membership is currently enrolled in an Excluded Membership Plan, recipient may choose to transfer the DashPass Gift Membership to another party. A DashPass Gift Membership entitles the recipient to a DashPass membership for the length of time identified in the DashPass Gift Membership confirmation (the “DashPass Gift Membership Period”).

For recipients enrolled in an eligible existing paid DashPass membership at the time of redemption of a DashPass Gift Membership, such eligible existing paid DashPass membership will continue through the end of the recipient’s current DashPass billing cycle before the DashPass Gift Membership will be applied. For recipients enrolled in an eligible existing DashPass membership currently in a free period at the time of redemption of a DashPass Gift Membership, the DashPass Gift Membership will be applied immediately upon redemption and any unused days in the previous free period will be forfeited.

For all recipients, after the DashPass Gift Membership Period ends, recipients WILL AUTOMATICALLY BE CHARGED THE THEN-CURRENT MONTHLY MEMBERSHIP FEE (“MEMBERSHIP FEE”) UNTIL RECIPIENT CANCELS. The Membership Fee will be charged to the preferred payment method designated in the recipient’s DoorDash account. DashPass benefits apply only to eligible orders from DashPass merchants that meet the minimum subtotal requirement. Subtotal minimums will be identified for each DashPass eligible merchant on DoorDash. Orders subject to availability. Other fees (including service fees), taxes & gratuity may apply. All purchases of DashPass Gift Memberships are final and non-refundable. DashPass Gift Memberships are not redeemable for cash except when required by applicable law. DashPass Gift Memberships will not expire. No fees apply to redemption of the DashPass Gift Memberships. DashPass Gift Memberships only valid for one-time redemption and cannot be resold. DashPass Gift Membership amounts cannot be increased or reloaded. DashPass Gift Memberships are only redeemable for DashPass memberships. DashPass Gift Memberships are not redeemable for orders placed on DoorDash, cash or any other goods or services; DashPass Gift Memberships cannot be exchanged or credited towards purchase of other memberships or subscriptions. DashPass Gift Membership are valid only if obtained directly from DoorDash; they are not valid and will not be honored if obtained from any third party. DashPass Gift Membership can only be redeemed in the same country and currency where purchased. DDGC is not responsible for unauthorized DashPass Gift Membership use. You may not purchase or obtain multiple DashPass Gift Memberships with a value of more than $10,000 in any one day. DDGC and/or DoorDash further reserves the right to deactivate, cancel, modify, or suspend DashPass Gift Memberships when we suspect fraud, unlawful activity, or any violation of the Terms and Conditions.

TO THE FULLEST EXTENT OF LAW DDGC AND/OR DOORDASH SHALL NOT BE LIABLE TO ANYONE FOR ANY INDIRECT, PUNITIVE, SPECIAL, EXEMPLARY, INCIDENTAL, CONSEQUENTIAL OR OTHER DAMAGES OF ANY TYPE OR KIND IN ANY WAY CONNECTED WITH DASHPASS GIFT MEMBERSHIPS. DDGC AND/OR DOORDASH SHALL NOT BE LIABLE FOR ANY LOSS, DAMAGE OR INJURY WHICH MAY BE INCURRED BY YOU, INCLUDING BUT NOT LIMITED TO LOSS OR IN ANY WAY CONNECTED WITH DASHPASS GIFT MEMBERSHIPS, EVEN IF DDGC, DOORDASH, AND/OR ITS LICENSORS HAVE BEEN PREVIOUSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE FULLEST EXTENT PERMISSIBLE BY LAW, IN THE EVENT AN ELIGIBLE DASHPASS GIFT MEMBERSHIP IS NON-FUNCTIONAL, YOUR SOLE REMEDY, AND OUR SOLE LIABILITY, WILL BE THE REPLACEMENT OF THAT DASHPASS GIFT MEMBERSHIP.

You agree that any dispute or claim relating in any way to DashPass Gift Memberships will be resolved by binding arbitration, rather than in court in accordance with the DoorDash Terms and Conditions. Please review the DoorDash Terms and Conditions carefully to understand how disputes will be resolved and your right to opt out.

DDGC reserves the right to change these DashPass Gift Membership Terms and Conditions from time to time in its discretion without special notice to you. Notice of changes will be by reasonable means, which may be by the posting of the revised version of these DashPass Gift Membership Terms and Conditions on this website (“Updated Terms”). Your use of a DashPass Gift Membership after DDGC has posted the Updated Terms constitutes your agreement to the Updated Terms. The Updated Terms will be effective as of the time of posting, or such later date as may be specified in the Updated Terms and will apply to your use of a Gift Card from that point forward. The date of the last update to these Gift Card Terms and Conditions is always indicated near the top of the page, and any change in the date of these Gift Card Terms and Conditions shall constitute notice to you that the Gift Card Terms and Conditions have changed.
