Offer Terms and Conditions: Consumer-Submitted Photos
From time to time, DoorDash (as defined in DoorDash’s Consumer Terms and Conditions) may offer you a promotion, discount, credits, or other incentive in exchange for you submitting a photo that we approve (collectively, “Offer”). To qualify for and receive the Offer, you must submit a photo of food that you ordered, meet the requirements indicated in the specific Offer, and comply with all of the terms and conditions below. Each specific Offer will contain details applicable to such Offer (e.g., amount of credits you may receive, expiration date).
Offer only available to select customers as indicated on the DoorDash platform when logged into their DoorDash account and for photos of select items. Offer may end without notice. You must have an active DoorDash account in order to receive an Offer. All Offers are subject to DoorDash’s Consumer Terms and Conditions and Promotional Offers and Credits Terms and Conditions.
Your submitted photo must: (1) be selected by DoorDash; (2) be of an eligible, unique menu item from a completed order (e.g., 5 photos of the same menu item are only eligible for an Offer once); (3) be tagged with the name of the menu item; (4) be an original photo that you have taken; (5) meet the DoorDash Review & Photo Guidelines; and (6) not be only of a prepackaged item (such as a bottled or canned beverage, bag of chips, or sauce), utensils, or napkins. You do not need to submit a review or rating in order to submit a photo. DoorDash reserves the right to use or display your photo even if you don’t qualify for the Offer or to not use or display your photo even if you do qualify for the Offer. Multiple photos of the same menu item are only eligible for an Offer once. You will be notified via email if your photo has been selected.
By submitting a photo, you grant DoorDash a perpetual, irrevocable, transferable, fully paid, royalty-free, non-exclusive, worldwide, fully sublicensable right and license to use, copy, display, publish, modify, remove, publicly perform, translate, create derivative works from, distribute, and/or otherwise use the photo in connection with DoorDash’s business and in all forms now known or hereafter invented, without notification to and/or approval by you. You represent and warrant that you are the owner of, or otherwise have the right to provide, any photo that you submit. You further represent and warrant that any photo you submit (a) does not violate any third-party right, including any copyright, trademark, patent, trade secret, privacy right, right of publicity, or any other intellectual property or proprietary right; (b) does not contain material that is false, intentionally misleading, or defamatory; (c) does not contain any material that is unlawful; (d) does not violate any law or regulation; and (e) does not violate, and is governed by, DoorDash's Consumer Terms and Conditions.
If the Offer is for you to receive DoorDash credits: (i) credits will be issued in the currency of the country associated with your DoorDash account, (ii) credits will be automatically added to your account and applied to your next order, (iii) credits may expire, (iv) amount of credits will be stated in the Offer, (v) maximum amount of credits that may be earned in connection with submitting photos to DoorDash is $500 per person per year, (vi) amount of credits and any other monetary or non-monetary consideration are inclusive of any applicable taxes, and (vii) credits are subject to DoorDash’s Promotional Offers and Credits Terms and Conditions. Further, if the Offer is for you to receive DoorDash credits in an amount equal to a percentage of an eligible item you ordered, in addition to the foregoing: (1) percentage will be applied to the price of the eligible item excluding fees and taxes, and (2) percentage and maximum amount of credits will be stated in the Offer. Any tax liabilities in relation to any supply by you to DoorDash are solely your responsibility.
If the Offer involves a percentage discount off a future order: (a) discount will be taken off the subtotal, (b) discount may be limited to a specific merchant, (c) discount may require use of a promo code, (d) discount percentage and maximum dollar value of the discount will be stated in the Offer, and (e) discount may expire.
