Gift Card Terms and Conditions—New Zealand

These Gift Card Terms and Conditions (“Gift Card Terms and Conditions”) apply to the purchase, acceptance, redemption, and usage of DoorDash gift cards in New Zealand (“Gift Cards”) and are between you and DoorDash Technologies New Zealand (“DoorDash,” “we,” “us,” or “Company”). By purchasing, accepting, redeeming, or using a Gift Card, you agree to both these Gift Card Terms and Conditions and also the DoorDash Consumer Terms and Conditions, including the arbitration and class waiver provision therein (collectively with the Gift Card Terms and Conditions, the “Terms and Conditions”). If you do not agree with the Terms and Conditions, do not purchase, accept, redeem, or use a Gift Card.

Gift Cards are issued by DoorDash Technologies New Zealand. Gift Cards can be purchased with or without a DoorDash account. However, a valid DoorDash account is required to use a Gift Card as the value of the Gift Card can only be used by first crediting the Gift Card’s value to a DoorDash account. You may only use or redeem a Gift Card in connection with your own DoorDash account.

Gift Card balances in a DoorDash account may be used to pay for any eligible order placed on www.doordash.com or in the DoorDash mobile application in New Zealand and to pay DoorDash fees related to an eligible order. DoorDash reserves the right to change the eligible orders at its sole reasonable discretion.

Gift Cards will not expire and any unused Gift Card balance will remain in the applicable DoorDash account for future use. However, if you have redeemed a Gift Card to your account, you will lose access to such Gift Card if your account is deactivated or deleted. No fees apply to Gift Cards. We further reserve the right to deactivate, cancel, or suspend Gift Cards when we expect fraud, unlawful activity, or any violation of the Terms and Conditions.

Gift Cards cannot be used to pay a credit card account. Gift Cards are not redeemable for cash or refundable, except when required by applicable law. Where a refund is required by law, the applicable amount will be credited to the applicable DoorDash account for future use. All Gift Card redemptions are final and may not be reversed, unless otherwise required by applicable law. Gift Cards may not be resold. Gift Card amounts may not be increased or reloaded. If a Gift Card’s balance is insufficient to fully pay for a purchase, the remaining balance must be paid using another form of payment. Gift Cards cannot be used to purchase other Gift Cards, prepaid open loop cards, or third-party gift cards. Gift Cards cannot be purchased using credits, promo codes, or other discounts, except as otherwise permitted.

WITHOUT EXCLUDING ANY RIGHTS THAT MAY APPLY UNDER THE CONSUMER GUARANTEES ACT 1993, BUT TO THE FULLEST EXTENT PERMISSIBLE BY LAW, COMPANY SHALL NOT BE LIABLE TO ANYONE FOR ANY INDIRECT, PUNITIVE, SPECIAL, EXEMPLARY, INCIDENTAL, CONSEQUENTIAL, OR OTHER DAMAGES OF ANY TYPE OR KIND IN ANY WAY CONNECTED WITH GIFT CARDS. COMPANY SHALL NOT BE LIABLE FOR ANY LOSS, DAMAGE, OR INJURY WHICH MAY BE INCURRED, INCLUDING BUT NOT LIMITED TO LOSS, DAMAGE, OR INJURY IN ANY WAY CONNECTED WITH GIFT CARDS, EVEN IF DOORDASH AND/OR ITS LICENSORS HAVE BEEN PREVIOUSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE FULLEST EXTENT PERMISSIBLE BY LAW, IN THE EVENT A GIFT CARD IS NON-FUNCTIONAL, DOORDASH WILL CREDIT THE APPLICABLE ACCOUNT WITH THE BALANCE OF THE NON-FUNCTIONING GIFT CARD, OR PROVIDE A REPLACEMENT GIFT CARD AT DOORDASH’S OPTION.

To the extent permitted by law, any dispute or claim relating in any way to Gift Cards will be resolved by binding arbitration, rather than in court, in accordance with the DoorDash Consumer Terms and Conditions. Please review the DoorDash Consumer Terms and Conditions carefully to understand how disputes will be resolved and your right to opt out.

DoorDash reserves the right to change these Gift Card Terms and Conditions from time to time in its discretion without special notice to you. Notice of changes will be by reasonable means, which may be by the posting of the revised version of these Gift Card Terms and Conditions online (“Updated Terms”). Your use of a Gift Card after DoorDash has posted the Updated Terms constitutes your agreement to the Updated Terms. The Updated Terms will be effective as of the time of posting or such later date as may be specified in the Updated Terms and will apply to your use of a Gift Card from that point forward. The date of the last update to these Gift Card Terms and Conditions is always indicated near the top of the page, and any change in the date of these Gift Card Terms and Conditions shall constitute notice to you that the Gift Card Terms and Conditions have changed.

This paragraph applies to purchasers that buy Gift Cards for the purpose of redistribution, including via any online bulk sales website (“Bulk Purchasers”). As a Bulk Purchaser, you agree that (a) under no circumstances shall you be considered the owner of any Gift Cards; (b) you shall not use or redeem the Gift Cards yourself; (c) you are purchasing the Gift Cards strictly for distribution in the ordinary course of your business to your individual customers, employees, and/or loyalty/rewards program participants, as applicable, for no monetary consideration; and (d) you will not resell or otherwise distribute the Gift Cards for monetary consideration. Any specific information regarding such distribution of Gift Cards is proprietary to you, and you shall not provide it to DoorDash in any form unless required by law. DoorDash agrees that it shall not request such information from Bulk Purchasers unless required by law to do so. By purchasing Gift Cards in bulk, each Bulk Purchaser hereby agrees and acknowledges to fully defend, indemnify, and hold harmless DoorDash and its related subsidiaries and affiliates from any action, loss, damage, or liability arising from, related to, or in connection with Bulk Purchaser’s purchase and redistribution of the Gift Cards in any jurisdiction.
